Objective: Ascertain if agency staff are working for Recruitment Consultants client directly outside of the contract

Our client contacted us as they had sourced and placed 4 members of staff with a large housing development company as labourers. Their housing development client had ceased their contract stating they no longer needed the staff, however our client believed they had hired them directly and to save paying the ‘buy out’ fee told the recruitment staff they were no longer required.

We commenced a full week of planned surveillance with 4 surveillance agents to cover all entrances and exits of the building site. We covered 10 hours a day to be on plot from the first staff arriving to the last staff leaving. We were able to identify all of the staff members turning up on site each day for the full week and working with the team of labourers.

We also sent an agent in undercover to speak with the office staff on site who also confirmed they were working for them as direct employees.

Our clients legal team was provided with the full report and they were able to approach the housing development company with our findings and settle on a figure for them breaching the terms of the contract.
