Client: Litigation Solicitor

Objective: Locate assets of debtor to pursue in litigation case.

We began our investigation looking into the subject debtor and his current finances. He was recorded as bankrupt with no assets. The subject didnt own his home, he had no current business affliations or shareholdings and was earning a small wage. We then began to look at the subject debtors family and closest associates.

The subject had recently seperated from his partner but further investigation showed he had children from a previous relationship. We then located records of his parents which showed his father passed away in a care home many years back and his mother had passed away in her home 5 years previous. A search for the will of his parents indicated that their home was inherited by our subject debtor and was valued at approximately £175,000. Further investigation then showed us the subject debtor had transferred the property into his sons name with zero value 2 weeks prior to filing for bankruptcy. We believe the subject did this to avoid paying his debts to creditors and also our client.

With this information the report was sent back to our client who were then able to speak with the Trustee in Bankrupcty and have the subjects bankruptcy status overturned with the debts issued as against the house with a charging order.
